These Terms and Conditions apply to all purchases made through New Creation 3D Prints and govern your use of our online store and the purchase of our products and services.
By placing an order with us, you agree to these Terms and Conditions.
1. About Our Business
New Creation 3D Prints is an Australian 3D printing business that designs, manufactures and sells 3D-printed products, including custom-made items, prototypes, accessories, decorations and other goods.
Our website and products are intended for lawful use only.
2. Products
Our products are manufactured using 3D printing technology. Because products are individually printed, minor variations may occur between products, including:
- Layer lines or visible print layers
- Minor surface imperfections
- Small variations in colour or finish
- Slight variations in dimensions
- Minor marks caused by the manufacturing or post-processing process
These characteristics are a normal part of 3D-printed products and do not necessarily constitute a defect.
We will make reasonable efforts to ensure that product photographs, descriptions, colours and dimensions accurately represent the products. However, colours may appear differently depending on your screen or device.
3. Product Information and Measurements
Unless otherwise stated, dimensions provided on our website are approximate.
Customers are responsible for checking product measurements and specifications before placing an order.
If an item is being purchased for use with another product, object or system, customers should confirm compatibility before ordering.
4. Custom and Made-to-Order Products
Some products may be manufactured specifically after an order is placed.
For custom orders, customers are responsible for providing accurate information, measurements, files, designs and instructions.
Once production of a custom product has commenced, changes or cancellations may not be possible.
We may contact you if clarification is required before manufacturing your order.
We reserve the right to refuse a custom order where the requested design is unsuitable, unsafe, unlawful or infringes another person's intellectual property rights.
5. Customer-Supplied Designs and Files
Where customers provide STL files, CAD files, images, drawings, measurements or other designs, the customer confirms that they have the necessary rights and permissions to have the item manufactured.
You must not provide files that:
- Infringe copyright, trademarks, patents or other intellectual property rights
- Are unlawful
- Are intended to facilitate unlawful activity
- Contain material that you do not have permission to reproduce
We may refuse to print a customer-supplied design if we have reasonable concerns regarding ownership, legality, safety or intellectual property.
6. Intellectual Property
Unless otherwise stated, all original designs, artwork, photographs, graphics, logos, product descriptions, branding and other content created by New Creation 3D Prints remain our intellectual property.
You must not copy, reproduce, modify, distribute, sell or commercially exploit our original designs or content without our written permission.
Where a customer supplies a design for printing, ownership of the customer's original design remains with the customer, subject to any rights belonging to third parties.
7. Orders
When you place an order, you are making an offer to purchase the selected products.
An order is considered accepted when we confirm the order and/or begin processing it.
We reserve the right to cancel or refuse an order where:
- A product is unavailable
- There is an obvious pricing or listing error
- We are unable to manufacture the product
- The requested product is unsafe or unlawful
- We reasonably believe the order may infringe intellectual property rights
- There has been an error in the order or payment process
If we cancel an order after payment has been received, we will provide an appropriate refund.
8. Pricing
All prices are displayed in Australian dollars (AUD) unless otherwise stated.
We reserve the right to change product prices at any time. Price changes will not affect orders that have already been accepted.
If an obvious pricing error occurs, we may contact you to correct the error or cancel the affected order and provide a refund.
Shipping and other applicable charges will be displayed during the checkout process.
9. Payment
Payment must be completed using the payment methods offered through our online store.
Orders will not be manufactured or dispatched until payment has been successfully received.
We are not responsible for delays caused by payment providers, banks or third-party payment services.
10. Production Times
3D-printed products may require manufacturing time before dispatch.
Estimated production times displayed on our website are estimates only and may vary depending on:
- Order volume
- Product size and complexity
- Material availability
- Printer availability
- Equipment problems
- Design changes
- Other circumstances outside our reasonable control
We will make reasonable efforts to manufacture orders within the stated timeframe.
11. Shipping and Delivery
Orders will be shipped to the address provided by the customer at checkout.
Customers are responsible for ensuring that their delivery information is correct.
We are not responsible for delays caused by postal services, courier companies, incorrect addresses, weather, natural disasters, industrial action, customs or other circumstances outside our reasonable control.
Once an order has been handed to the shipping provider, delivery is the responsibility of the shipping provider, subject to your rights under Australian Consumer Law.
If an order appears to be lost or significantly delayed, please contact us so that we can assist with making enquiries with the relevant delivery provider.
12. Damaged Items
Please inspect your order when it arrives.
If your product has been damaged during delivery, contact us as soon as reasonably possible and provide:
- Your order number
- A description of the damage
- Photographs of the damaged product
- Photographs of the packaging, where applicable
We will assess the issue and determine an appropriate remedy in accordance with Australian Consumer Law.
13. Returns and Change of Mind
Nothing in these Terms and Conditions excludes, restricts or modifies any rights you may have under the Australian Consumer Law.
If a product has a problem covered by the Australian Consumer Law, you may be entitled to a repair, replacement, refund or other remedy depending on the circumstances.
For products that are not faulty and where you simply change your mind, returns may be subject to our applicable return policy.
Custom-made or personalised products may not be eligible for change-of-mind returns where permitted by law.
14. Australian Consumer Law
Our products and services are provided subject to the consumer guarantees contained in the Competition and Consumer Act 2010 (Cth) and the Australian Consumer Law.
Nothing in these Terms and Conditions is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot legally be excluded.
15. Product Use and Safety
Our products must be used only for their intended purpose and in accordance with any instructions or warnings provided with the product.
Customers are responsible for determining whether a product is suitable for their particular application.
Unless specifically stated otherwise, our 3D-printed products should not be assumed to be:
- Load-bearing structural components
- Safety-critical components
- Suitable for high-temperature applications
- Suitable for food contact
- Suitable for medical use
- Suitable for use in vehicles or machinery
- Suitable for children's unsupervised use
- Suitable for outdoor exposure
Customers should contact us before ordering if they require a product for a specialised or safety-critical application.
16. Children and Small Parts
Some 3D-printed products may contain small parts, detachable components or sharp edges.
Products that are not specifically marketed as children's products should not be given to young children without appropriate adult supervision.
Customers are responsible for assessing whether a product is appropriate for the intended user and responsible for children supervision.
17. Materials
We may manufacture products using materials such as PLA, PETG, ABS, ASA, TPU, nylon or other suitable 3D-printing materials.
Different materials have different properties, including strength, flexibility, heat resistance and UV resistance.
The material used will generally be specified in the product listing or agreed with the customer for custom orders.
18. Outdoor and Heat Exposure
3D-printed plastics can deform, soften, become brittle or otherwise change when exposed to heat, sunlight, chemicals or environmental conditions.
Unless specifically stated otherwise, products should not be exposed to excessive heat or prolonged direct sunlight.
Customers should contact us if a product is intended for use in high-temperature, outdoor or harsh environments so that an appropriate material can be considered.
19. Food Contact
Unless a product is specifically identified by us as suitable for food contact, our 3D-printed products should not be used for storing, preparing or serving food or beverages.
The layer-by-layer nature of FDM 3D printing can create surface characteristics that may make cleaning and sanitation difficult.
20. Custom Product Approval
For certain custom products, we may provide an image, drawing, render or description for customer approval before manufacturing.
Where approval is requested, the customer is responsible for checking the approved design, dimensions, wording and other details before production begins.
Once approved, changes may incur additional costs or require a new order.
21. Product Defects
If you believe your product is defective or does not meet the description provided, please contact us with details of the issue.
We may request photographs, measurements or other information to help assess the issue.
Where a product has a problem covered by Australian Consumer Law, we will provide the remedy required by law.
22. Limitation of Liability
To the maximum extent permitted by law, we are not responsible for loss or damage resulting from:
- Incorrect installation or assembly
- Misuse of a product
- Use outside the product's intended purpose
- Modification of a product by the customer or another party
- Failure to follow supplied instructions or warnings
- Use of a product in an application for which it was not designed
Nothing in these Terms and Conditions limits any liability or consumer right that cannot legally be limited or excluded under Australian law.
23. Website Information
We make reasonable efforts to keep our website, product descriptions and pricing accurate.
However, errors, omissions, typographical mistakes and technical issues may occasionally occur.
We reserve the right to correct errors and update website information where necessary.
24. Privacy
Personal information provided to us will be handled in accordance with our Privacy Policy.
We may collect information necessary to process orders, communicate with customers, arrange delivery and provide customer service.
25. Force Majeure
We are not responsible for delays or failures caused by circumstances outside our reasonable control, including natural disasters, severe weather, power outages, equipment failures, internet or telecommunications failures, supplier shortages, transport disruptions, industrial action or other unforeseen circumstances.
26. Changes to These Terms
We may update these Terms and Conditions from time to time.
The latest version will be published on our website and will apply to orders placed after the updated terms take effect.
27. Governing Law
These Terms and Conditions are governed by the laws of the state or territory of Australia in which our business operates, together with applicable Australian Commonwealth law.
Any disputes will be dealt with in accordance with applicable Australian law.
